Terms of Service

1. Services Provided

Cardiff by the Sea Tow Service provides towing, roadside assistance, and related vehicle recovery services in Cardiff, CA and surrounding areas. Services include but are not limited to emergency towing, flatbed towing, jump starts, battery replacement, flat tire changes, lockout assistance, winch out service, accident recovery, motorcycle towing, long distance towing, and heavy duty towing.

All services are subject to availability and the company reserves the right to decline any service request at its sole discretion, including situations where the requested service would be unsafe, unlawful, or outside our service area.

2. Authorization to Tow or Service

By requesting our services, you confirm that you are the registered owner of the vehicle, or that you have the legal authority to authorize towing and roadside services on behalf of the registered owner. Cardiff by the Sea Tow Service is not responsible for disputes arising from unauthorized service requests.

You agree to provide accurate information about your vehicle, its location, and the nature of the problem when requesting services. Providing false or misleading information may result in additional charges or refusal of service.

3. Pricing and Payment

Prices for all services will be communicated to you before work begins. By proceeding with a service after receiving a quote, you agree to pay the stated amount. All prices are in U.S. dollars.

Payment is due at the time of service unless otherwise agreed upon in writing. We accept cash, major credit cards, and debit cards. Returned checks and chargebacks may result in additional fees.

Additional charges may apply in situations involving unusual circumstances such as off-road recovery, vehicle modifications that complicate loading, or multi-stop towing, and these will be disclosed before work proceeds.

4. Vehicle Condition and Pre-Existing Damage

Cardiff by the Sea Tow Service will conduct a visual inspection of your vehicle before service. Any pre-existing damage observed will be noted at the time of service. We are not responsible for pre-existing damage, mechanical failures that occur during towing of an already-damaged vehicle, or damage caused by vehicle defects not visible prior to service.

In the event that our driver causes damage to your vehicle during towing or service, you must report this to our company before the driver leaves the location. Claims made after the driver has departed may be subject to additional review.

5. Limitation of Liability

To the fullest extent permitted by law, Cardiff by the Sea Tow Service is not liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability for any claim arising from a single service event shall not exceed the amount paid for that service.

We are not liable for delays caused by traffic, weather, road closures, third-party interference, or other circumstances outside our reasonable control.

6. Personal Belongings

You are responsible for removing any valuables or personal belongings from your vehicle before it is towed, when it is practical and safe to do so. Cardiff by the Sea Tow Service is not responsible for the loss, theft, or damage of personal items left inside a vehicle during towing or storage.

7. Cancellations

You may cancel a service request at any time before our driver arrives at no charge. If a driver has already been dispatched and is en route, a cancellation fee may apply to cover fuel and time. This fee will be communicated if applicable.

8. Governing Law

These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in San Diego County, California.

9. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be reflected on this page with an updated effective date. Your continued use of our services after any changes constitutes acceptance of the revised terms.
